In celebration of Newton da Costa’s place in the history of paraconsistency, this paper considers the use and abuse of deliberate self-contradiction. Beginning with Parmenides, developed by Plato, and continued by Cicero, an ancient philosophical tradition used deliberately paraconsistent discourses to reveal the truth. Although the commentary on Aristotle’s problematic discussion of slavery is vast, his discussion of nobility receives little attention. The fragments of his dialogue On Noble Birth constitute his most extensive examination of nobility, and while their similarity to the παμβασιλεύς of the Politics has recently been recognized, their relevance to natural slavery has hitherto gone unnoticed. Yet by declaring that true nobles – particularly the god-like ἀρχηγός – preternaturally possess superhuman characteristics, Aristotle precludes their easy inclusion in the kind “human” (...) in a manner inversely mirroring the preternatural subhumanity of natural slaves. Building on recent scholarship which argues that Aristotle’s “defense” of natural slaves is better understood as an indictment, On Noble Birth becomes most coherent if read as a hypothetical investigation into what would be required for “nobility” to name something true rather than equivocal, with the conclusion that “true nobility” is an empty set. How does microbiota research impact our understanding of biological individuality? We summarize the interdisciplinary summer school on "Microbiota, Symbiosis and Individuality: Conceptual and Philosophical Issues" (July 2019), which was supported by a European Research Council starting grant project "Immunity, DEvelopment, and the Microbiota" (IDEM). The summer school centered around interdisciplinary group work on four facets of microbiota research: holobionts, individuality, causation, and human health. The conceptual discussion of cutting-edge empirical research provided new insights into microbiota and highlights the value of (...) incorporating into meetings experts from other disciplines, such as philosophy and history of science. The Repugnant Conclusion served an important purpose in catalyzing and inspiring the pioneering stage of population ethics research. We believe, however, that the Repugnant Conclusion now receives too much focus. Avoiding the Repugnant Conclusion should no longer be the central goal driving population ethics research, despite its importance to the fundamental accomplishments of the existing literature.

In this reply to James H. Fetzer’s “Minds and Machines: Limits to Simulations of Thought and Action”, I argue that computationalism should not be the view that (human) cognition is computation, but that it should be the view that cognition (simpliciter) is computable. It follows that computationalism can be true even if (human) cognition is not the result of computations in the brain. I also argue that, if semiotic systems are systems that interpret signs, then both humans and computers are (...) semiotic systems. Finally, I suggest that minds can be considered as virtual machines implemented in certain semiotic systems, primarily the brain, but also AI computers. In doing so, I take issue with Fetzer’s arguments to the contrary. (shrink)

Here we clarify that thesis, reply to criticisms advanced by Lange (2017), consider alternative formulations of Inference to the Best Explanation, discuss a strengthened screening-off thesis, and consider how (...) it bears on the claim that unification is evidentially relevant. H´ector-Neri Casta˜neda-Calder´on (December 13, 1924–September 7, 1991) was born in San Vicente Zacapa, Guatemala. He attended the Normal School for Boys in Guatemala City, later called the Military Normal School for Boys, from which he was expelled for refusing to fight a bully; the dramatic story, worthy of being filmed, is told in the “De Re” section of his autobiography, “Self-Profile” (1986). He then attended a normal school in Costa Rica, followed by studies in philosophy at the University of San (...) Carlos, Guatemala. He won a scholarship to the University of Minnesota, where he received his B.A. (1950), M.A. (1952), and Ph.D. (1954), all in philosophy. His dissertation, “The Logical Structure of Moral Reasoning”, was written under the direction of Wilfrid Sellars. He returned to teach in Guatemala, and then received a scholarship to study at Oxford University (1955–1956), after which he took a sabbatical-replacement position in philosophy at Duke University (1956). His first full-time academic appointment was at Wayne State University (1957– 1969), where he founded the philosophy journal Noˆus (1967, a counter-offer made to him by Wayne State to encourage him to stay there rather than to take the chairmanship of philosophy at the University of Pennsylvania). In 1969, he moved (along with several of his Wayne colleagues) to Indiana University, where he eventually became the Mahlon Powell Professor of Philosophy and, later, its first Dean of Latino Affairs (1978–1981). He remained at Indiana until his death. He was also a visiting professor of philosophy at the University of Texas at Austin (1962–1963) and a fellow at the Center for Advanced Study in the Behavioral Sciences (1981–1982). He received grants and fellowships from the Guggenheim Foundation (1967–1968), the T. Andrew Mellon Foundation, the National Endowment for the Humanities, and the National Science Foundation. He was elected President of the American Philosophical Association Central Division (1979– 1980), named to the American Academy of Arts and Sciences (1990), and received the Presidential Medal of Honor from the Government of Guatemala (1991). Objective: There are benefits and risks of giving patients more granular control of their personal health information in electronic health record (EHR) systems. When designing EHR systems and policies, informaticists and system developers must balance these benefits and risks. Ethical considerations should be an explicit part of this balancing. Our objective was to develop a structured ethics framework to accomplish this. -/- Methods: We reviewed existing literature on the ethical and policy issues, developed an ethics framework called a “Points to (...) Consider” (P2C) document, and convened a national expert panel to review and critique the P2C. -/- Results: We developed the P2C to aid informaticists designing an advanced query tool for an electronic health record (EHR) system in Indianapolis. The P2C consists of six questions (“Points”) that frame important ethical issues, apply accepted principles of bioethics and Fair Information Practices, comment on how questions might be answered, and address implications for patient care. -/- Discussion: The P2C is intended to clarify whatis at stake when designers try to accommodate potentially competing ethical commitments and logistical realities. The P2C was developed to guide informaticists who were designing a query tool in an existing EHR that would permit patient granular control. While consideration of ethical issues is coming to the forefront of medical informatics design and development practices, more reflection is needed to facilitate optimal collaboration between designers and ethicists. Then O screens-off E from H: Pr = Pr. This thesis, hereafter “SOT” , is defended by appeal to a representative case. The case concerns smoking and lung cancer. McCain and Poston grant that SOT holds in cases, like our case concerning smoking and lung cancer, that involve frequency (...) data. However, McCain and Poston contend that there is a wider sense of evidential relevance—wider than the sense at play in SOT—on which explanatoriness is evidentially relevant even in cases involving frequency data. This is their main point, but they also contend that SOT does not hold in certain cases not involving frequency data. How should we interpret the Constitution? The “positive turn” in legal scholarship treats constitutional interpretation, like the interpretation of statutes or contracts, as governed by legal rules grounded in actual practice. In our legal system, that practice requires a certain form of originalism: our system’s official story is that we follow the law of the Founding, plus all lawful changes made since. Or so we’ve argued. Yet this answer produces its own set of questions. How can practice solve our problems, (...) when there are so many theories of law, each giving practice a different role? Why look to an official story, when on-the-ground practice may be confused or divided—or may even make the story ring false? And why take originalism as the official story, when so many scholars and judges seem to reject it? This Essay offers a response to each. To the extent that legal systems are features of particular societies, a useful theory will have to pay attention to actual social practice, including the aspects of legal practice we describe. This positive focus really can resolve a great many contentious legal disputes, as shared legal premises lead to conclusions that might surprise us or that ultimately establish one side in a dispute as correct. The most serious challenge to our view is the empirical one: whether originalism is or isn’t the official story of our law. Stripped of their jurisprudential confusion, though, the best competing accounts of our law seem to have far less supporting evidence than our own account. Focusing on social practice as it stands today turns out to direct our attention to the Founders and to the changes over time that their law has recognized. (shrink)

Bayesian confirmation theory is rife with confirmation measures. Many of them differ from each other in important respects. It turns out, though, that all the standard confirmation measures in the literature run counter to the so-called “Reverse Matthew Effect” (“RME” for short). Suppose, to illustrate, that H1 and H2 are equally successful in predicting E in that p(E | H1)/p(E) = p(E | H2)/p(E) > 1. Suppose, further, that initially H1 is less probable than H2 in that p(H1) < p(H2). (...) Then by RME it follows that the degree to which E confirms H1 is greater than the degree to which it confirms H2. But by all the standard confirmation measures in the literature, in contrast, it follows that the degree to which E confirms H1 is less than or equal to the degree to which it confirms H2. It might seem, then, that RME should be rejected as implausible. Festa (2012), however, argues that there are scientific contexts in which RME holds. If Festa’s argument is sound, it follows that there are scientific contexts in which none of the standard confirmation measures in the literature is adequate. Festa’s argument is thus interesting, important, and deserving of careful examination. I consider five distinct respects in which E can be related to H, use them to construct five distinct ways of understanding confirmation measures, which I call “Increase in Probability”, “Partial Dependence”, “Partial Entailment”, “Partial Discrimination”, and “Popper Corroboration”, and argue that each such way runs counter to RME. The result is that it is not at all clear that there is a place in Bayesian confirmation theory for RME. (shrink)

There are many scientific and everyday cases where each of Pr and Pr is high and it seems that Pr is high. But high probability is not transitive and so it might be in such cases that each of Pr and Pr is high and in fact Pr is not high. There is no issue in the special case where the following condition, which I call “C1”, holds: H 1 entails H 2. This condition is sufficient for transitivity in high (...) probability. But many of the scientific and everyday cases referred to above are cases where it is not the case that H 1 entails H 2. I consider whether there are additional conditions sufficient for transitivity in high probability. I consider three candidate conditions. I call them “C2”, “C3”, and “C2&3”. I argue that C2&3, but neither C2 nor C3, is sufficient for transitivity in high probability. I then set out some further results and relate the discussion to the Bayesian requirement of coherence. This book presents the author’s many and varied contributions to the revival and re-evaluation of American pragmatism. The assembled critical perspective on contemporary pragmatism in philosophy emphasizes the American tradition of cultural pluralism and the requirements of American democracy. Based partly on a survey of the literature on interest-group pluralism and critical perspectives on the politics of globalization, the monograph argues for reasoned caution concerning the practical effects of the revival. Undercurrents of “vulgar pragmatism” including both moral and epistemic relativism (...) threaten the intellectual and moral integrity of American thought – and have contributed to the present sense of political crisis. -/- The text chiefly contributes to the evaluation of the contemporary influence of the philosophy of John Dewey (1859–1952) and his late development of the classical pragmatist tradition. In comparison to Ralph Waldo Emerson (1803–1882), William James (1842–1910), and earlier currents of American thought, Dewey’s philosophy, dominated by its overall emphasis on unification, is weaker in its support for the pluralism of cultural and religious contributions which have lent moral self-restraint to American policy and politics, both foreign and domestic. With all due homage to Dewey’s conception of philosophy, centered on human problems and the need for our ameliorative efforts, the argument is that in the contemporary revival, Dewey’s thought has been too often captured by “post-modernist” bandwagons of self-promotion and institutional control. -/- This work defends democratic individualism against more collectivist and corporatist tendencies in contemporary neo-pragmatism, and it draws upon up-to-date political analysis in defense of America’s long republican tradition. Pragmatism will not and cannot be removed from, or ignored, in American intellectual and moral history; and its influence on disciplines from law to politics, sociology and literary criticism has been immense. Hempel’s Converse Consequence Condition (CCC), Entailment Condition (EC), and Special Consequence Condition (SCC) have some prima facie plausibility when taken individually. Hempel, though, shows that they have no plausibility when taken together, for together they entail that E confirms H for any propositions E and H. This is “Hempel’s paradox”. It turns out that Hempel’s argument would fail if one or more of CCC, EC, and SCC were modified in terms of explanation. In this thesis I present a new paradigm in human evolutionary theory: the relevance of track-ways reading (TWR) to the evolution of human cognition, culture and communication. Evidence is presented that strongly indicates hominins were exploiting conspecific track-ways 4 million years ago. For a non-olfactory ape that was a specialized forager in open, featureless wetland environments, they were the only viable natural signs to exploit for safety, orienteering, and recognizable social markers. Due to the unique cognitive demands of reading track-ways, (...) as compared to scent-trails all other animals use to find each other and preferred prey species, social TWR triggered the evolution of a unique faculty for narrative elsewhere-and-when cognition in the hominin mind. Two million years later, this narrative faculty was entrenched enough to enable the rather sudden ‘explosion’ of co-operative Oldowan Lithic Culture that began at 2.6mya. This cultural adaptation was a highly successful response to catastrophic environmental change. Thereafter selection for encephalization to increase neural capacity to store and co-operatively exploit socio-ecological knowledge gained from the hominin narrative faculty (via co-evolving, increasingly efficient modes of intentional communication) drove all further biological and cultural developments in the hominin trajectory towards H.sapiens and behavioural modernity. He also considers a variant of SOT, called (...) “SOT*”, and contends that it too gives the wrong result. Plato’s Laws include what H.L.A. Hart called the ‘classical thesis’ about the nature and role of law: the law exists to see that one leads a morally good life. This paper develops Hart’s brief remarks by providing a panorama of the classical thesis in Laws. This is done by considering two themes: (1) the extent to which Laws is paternalistic, and (2) the extent to which Laws is naturalistic. These themes are significant for a number of reasons, including because they (...) show how Laws might be viewed as a sophisticated forerunner of natural law theory. The upshot is that Plato's metaphysical commitments about legal ontology allow him to base the truth of legal propositions on the way they relate to the truth of corresponding moral propositions. Bayesian confirmation theory is rife with confirmation measures. Zalabardo focuses on the probability difference measure, the probability ratio measure, the likelihood difference measure, and the likelihood ratio measure. He argues that the likelihood ratio measure is adequate, but each of the other three measures is not. He argues for this by setting out three adequacy conditions on confirmation measures and arguing in effect that all of them are met by the likelihood ratio measure but not by any of the other (...) three measures. Glass and McCartney, hereafter “G&M,” accept the conclusion of Zalabardo’s argument along with each of the premises in it. They nonetheless try to improve on Zalabardo’s argument by replacing his third adequacy condition with a weaker condition. They do this because of a worry to the effect that Zalabardo’s third adequacy condition runs counter to the idea behind his first adequacy condition. G&M have in mind confirmation in the sense of increase in probability: the degree to which E confirms H is a matter of the degree to which E increases H’s probability. I call this sense of confirmation “IP.” I set out four ways of precisifying IP. I call them “IP1,” “IP2,” “IP3,” and “IP4.” Each of them is based on the assumption that the degree to which E increases H’s probability is a matter of the distance between p and a certain other probability involving H. Most of its critics seem to think that utilitarianism is not bad per se, but prone to be misapplied in a self-serving way. (...) That idea, William H. Foucault's theory of power and subjectification challenges common concepts of freedom in social philosophy and expands them through the concept of 'freedom as critique': Freedom can be defined as the capability to critically reflect one's own subjectification, and the conditions of possibility for this critical capacity lie in political and social institutions. The article develops this concept through a critical discussion of the standard response by Foucault interpreters to the standard objection that Foucault's thinking obscures freedom. The standard response interprets (...) Fou-cault's later works, especially The Subject and Power, as a solution to the problem of freedom. It is mistaken, because it conflates different concepts of freedom that are present in Foucault's work. By differentiating these concepts, this paper proposes a new institutionalist approach to solve the problem of freedom that breaks with the partly anarchist underpinnings of Foucault scholarship: As freedom as critique is not given, but itself a result of subjectification, it entails a demand for 'modal robustness' and must therefore be institutionalized. This approach helps to draw out the consequences of Foucault's thinking on freedom for postfoundationalist democratic theory and the general social-philosophical discussion on freedom. (shrink)

PrEP (Pre-Exposure Prophylaxis) is a relatively new drug-based HIV prevention technique and an important means to lower the HIV risk of gay men who are especially vulnerable to HIV. From the perspective of biopolitics, PrEP inscribes itself in a larger trend of medicalization and the rise of pharmapower. This article reconstructs and evaluates contemporary literature on biopolitical theory as it applies to PrEP, by bringing it in a dialogue with a mapping of the political debate on PrEP. As PrEP changes (...) sexual norms and subjectification, for example condom use and its meaning for gay subjectivity, it is highly contested. The article shows that the debate on PrEP can be best described with the concepts ‘sexual-somatic ethics’ and ‘democratic biopolitics’, which I develop based on the biopolitical approach of Nikolas Rose and Paul Rabinow. In contrast, interpretations of PrEP which are following governmentality studies or Italian Theory amount to either farfetched or trivial positions on PrEP, when seen in light of the political debate. Furthermore, the article is a contribution to the scholarship on gay subjectivity, highlighting how homophobia and homonormativity haunts gay sex even in liberal environments, and how PrEP can serve as an entry point for the destigmatization of gay sexuality and transformation of gay subjectivity. ‘Biopolitical democratization’ entails making explicit how medical technology and health care relates to sexual subjectification and ethics, to strengthen the voice of (potential) PrEP users in health politics, and to renegotiate the profit and power of Big Pharma. In der sozialphilosophischen Debatte um Freiheit bei Foucault wird das ‚Freiheitsproblem‘ verhandelt: Wie können Freiheit und Widerstand innerhalb von Foucaults Theorie der Macht und Subjektivierung konzipiert werden? Die Arbeit unterscheidet systematisch vier verschiedene Interpretationsstrategien von Foucaults Werk, die es als kohärente sozialphilosophische Theorie konstruieren und dabei das Freiheitsproblem lösen sollen; sie rekonstruiert die Arbeiten von exemplarischen Vertreter_innen dieser Strategien: 1. Foucault ist kohärent (Paul Patton), 2. Foucault korrigiert sich (Thomas Lemke), 3. Foucault kritisiert kohärent (Martin Saar), 4. Foucault ist nicht (...) genug (Amy Allen). Das erste Ziel der Arbeit ist, die Debatte und die in ihr verhandelten Probleme und Begriffe durch die systematische Rekonstruktion zu differenzieren und klarer zu fassen. Dafür werden einige neue systematische Unterscheidungen entwickelt: u.a. das Freiheitsproblem der Machtdetermination im Gegensatz zum Freiheitproblem der Subjektivierung, Freiheit als Anders-handeln-Können im Gegensatz zu Freiheit als Kritik, verschiedene Modalitäten dieser Freiheitsbegriffe und eine Foucault-Lesart der Regierungstranszendenz im Gegensatz zu einer Lesart der radikalen Immanenz. Das zweite Ziel der Arbeit ist die Entwicklung einer neuen These zur Freiheit im Rahmen einer Subjektivierungstheorie durch die interne Kritik der vier Interpretationsstrategien auf Grundlage der dort entwickelten Differenzierungen. Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung ‒ kurz: Freiheit als Kritik ‒ kann verstanden werden als das Resultat von freiheitlicher Subjektivierung, deren gesellschaftlicher Ort politische Institutionen sind, die im Rahmen einer postfundamentalen, pluralen und liberalen politischen Theorie bestimmt werden können. Drittens verfolgt die Arbeit das Ziel, durch den Begriff der Freiheit als Kritik die allgemeine sozialphilosophische Debatte um Freiheitsbegriffe zu erweitern und ihn als einen Kandidaten neben der negativen, reflexiven und sozialen Freiheit zu präsentieren, der einerseits plausible Einsichten dieser drei Ansätze aufnimmt und andererseits ihre blinden Flecken korrigiert. „Political Correctness“, „Identitätspolitik“ und „Cancel Culture“ werden heutzutage überwiegend als Waffen von Konservativen eingesetzt, um ihre Privilegien gegen emanzipative Neuregelungen zu verteidigen. Solche Neuregelungen als Einschränkung der Kunst- und Meinungsfreiheit zu kritisieren ist deshalb meist falsch. Tatsächlich tragen „Political Correctness“, „Identitätspolitik“ und „Cancel Culture“ zur inklusiveren Verwirklichung der Demokratie bei. Im Artikel zeige ich, dass es darauf ankommt, auf welcher Ebene politische Regulierungen der Kunst stattfinden: nicht-staatlich im allgemeinen Kunstbetrieb, para-staatlich im öffentlich-rechtlichen Rundfunk, oder staatlich. Nur wenn der Staat mit (...) zentralisierter rechtlicher, ökonomischer und symbolischer Macht in laufende Debatten eingreift, kann man von problematischer Cancel Culture sprechen - das ist fast nie der Fall. Right-wing intellectuals often invoke Nietzsche's concept of slave morality to underpin their criticism of 'political correctness' ('PC'). This interconnection of Nietzsche's slave morality and 'PC' criticism is correct, as a systematic analysis of their common elements shows, which leads to a new description of 'PC' criticism as a defense of privilege. In contrast to the right-wing Nietzschean 'PC' critique, the left-wing Nietzschean concept of a privilege-critical ‘political judgement' understands politics as a struggle for power, in which the space of the (...) political and related discourses are always already regulated and determine the conditions under which resources and privileges are distributed. Therefore, it is appropriate for an emancipatory position to critically question the established norms and to support political projects that aim to rewrite them. Because 'PC', as emancipative political judgement, dismantles privileges, its restricting of the privileged is not a side effect to be avoided but one of its reasonable core effects. Left-wing Nietzscheanism helps to avoid being surprised by right-wing aggression and to counter it vigorously by setting strict political norms. (shrink)

Karsten Schubert liefert die erste systematische Rekonstruktion der sozialphilosophischen Debatte um Freiheit bei Foucault und eine neue Lösung für das Freiheitsproblem: Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung – kurz: Freiheit als Kritik – ist das Resultat von freiheitlicher Subjektivierung in politischen Institutionen. Der Band zeigt so die Konsequenzen von Foucaults Freiheitsdenken für die Demokratietheorie und die allgemeine sozialphilosophische Freiheitsdiskussion auf.

Finally published 34 years after his death, Foucault's book Confessions of the Flesh sheds new light on the debate about freedom and power that shaped the reception of his works. Many contributors to this debate argue that Foucault's theory of power did not allow for freedom in the 'genealogical phase,' but that he corrected himself and presented a solution to the problem of freedom in his later works, especially through his reflection on ancient ethics and technologies of the self in (...) volumes two and three of History of Sexuality, as well as the concept of parrhesia. In contrast to this view, I argue that Confessions of the Flesh shows that a concept of freedom as self-critical hermeneutics that aims at identifying a foreign power within the subject was only developed in Foucault's analysis of Christian practices of penance and confession. This interpretation of Confessions of the Flesh opens a new field of inquiry into the genealogy of critique and both the repressive and emancipative effects of truth-telling and juridification. In der postmarxistischen politischen Philosophie wird die Veränderung gegenüber der Verstetigung analytisch und normativ bevorzugt. Deshalbleistet die postmarxistische Theorie keine realistische Analyse und normativ-differenzierende Bewertung von politischen Institutionen, insbesondere des Rechts. Der Beitrag liefert einen Ansatz, um diese Lücke zu schließen, indem er der Abblendung von institutionellen Fragen mit einer neuen postfundamentalistischen Institutionentheorie begegnet. Diese Theorie basiert auf dem Freiheitsbegriff der Kritik, der im Anschluss an Foucault entwickelt wird und zeigt, dass kritischer Subjektivität durch die Institutionalisierung von freiheitlichen Subjektivierungsregimen bedingt (...) ist. Dieser Freiheitsbegriff korrigiert den avanciertesten Ansatz der postmarxistischen Rechtstheorie, Menkes Rechtskritik. Deren Stärke ist es,die liberal entpolitisierende Subjektivierung des Rechts zu kritisieren, doch Menkes Vorschlag einer radikalen Politisierung ist paternalistisch. Mit Foucault lässt sich hingegen ein Recht denken, das Subjektivierung kritisiert und dennoch nicht paternalistisch ist, weil es die Subjekte zur Kritik der Institutionen befähigt. (shrink)

Ein Grundprinzip der Demokratie ist die Gleichheit der Bürger_innen. Das Prinzip der Gleichheit ist zentral für demokratische Repräsentation. Es bedeutet, dass die Stimmen der Bürger_innen gleich viel zählen und dass ihre Interessen durch Repräsentant_innen möglichst gut abgebildet und vertreten werden. Es gilt sowohl für formale Repräsentation in den poli- tischen Institutionen, insbesondere bei Wahlen, als auch für sogenannte informelle Repräsentationsverhältnisse in der Öffentlichkeit, Kultur und Wissenschaft. Doch die real existierende Demokratie ist vom Ideal der Gleichheit weit entfernt. Sie ist asymmetrisch (...) und exkludierend. Die Stim- men privilegierter Menschen sind überrepräsentiert, während die Stimmen von diskriminierten Menschen unterrepräsentiert oder sogar ganz ausge- schlossen sind. (shrink)

Wie Herrschaft kritisieren, wenn Kategorien wie Staat, Souveränität und Demokratie nicht mehr funktionieren? Der Regimebegriff verspricht einen Ausweg aus diesem praktischen wie theoretischen Dilemma. Er soll nicht nur helfen, Macht und Herrschaft besser zu verstehen, sondern auch eine neue Grundlage für tiefere und radikalere Gesellschaftskritik bieten: Das Denken in Regimen bezieht Denk- und Wahrnehmungsmuster in die Analyse und Kritik von gesellschaftlichen Strukturen, (politischer) Macht und alltäglichen Normen und Praxen ein. Kurz: Regimeanalysen helfen uns zu sehen, was sonst unsichtbar bliebe, wie (...) etwa die rassistische Regulierung von Migration, die Normierung von Geschlechterverhältnissen oder die Neoliberalisierung von Universitäten. Es wundert nicht, dass ein Begriff, mit dem solch verschiedene Phänomene beschrieben werden können, »sehr weitläufig und oft ungenau und spekulativ« ist. Die AutorInnen aus dem Umfeld der Wiener Akademie der Künste führen deshalb in ihren Buchbeiträgen zunächst in die unterschiedlichen Regimebegriffe ein und möchten untersuchen, »welchen diskursiven und politischen Gewinn er verspricht und tatsächlich bringt.«. A representationalist-friendly introduction to representationalism which covers a number of central problems and objections.

While ‘cancel culture’ is commonly regarded as limiting freedom of speech and artistic freedom, this article proposes a new understanding of ‘cancel culture’ as emancipatory norm-setting that is key for democratization. On a non-governmental level of the self-regulation of the art world, the argument for artistic freedom ignores the fact that art is permeated by power. The introduction of ‘politically correct’ norms leads to a justified redistribution of such power. On a parastatal level of public broadcasting and state cultural funding, (...) neutrality is necessary but should be understood materially to include marginalized voices. Restrictions of freedom of speech and artistic freedom do occur on the state-level of hate-speech regulation. Here, the danger of a potential shift from emancipatory regulation to a harmful restriction is particularly virulent, as a discussion of the German BDS ban shows. (shrink)

Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies birgt ein Problem für die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als radikaldemokratisch-normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. (shrink)

This article aims to read feminist new materialisms (Barad), together with ‘postulated’ linguistic or cultural primacy of Queer Theory (Butler), to show how both are engaged in similar critical-ethical endeavours. The central argument is that the criticism of Barad and new materialisms misses Butler’s materialistic insights due to a narrow interpretation of Butler's alleged social-constructivist position. There is, therefore, a specific focus on where they both make similar ethical appeals. Moreover, the article relies on Adorno's negative dialectic to highlight an (...) interpretation of Barad and Butler as being part of the same dialectical movement, in which materialism and idealism fluctuate in their mutual criticisms, thus continuing the procession towards 'new knowledge' and emancipation, or freedom, through their motions back and forth. Vom lange unter Verschluss gehaltenen Band erhofft sich die Leser_innenschaft neue Erkenntnisse nicht nur zum Thema des Buches – die Reflexionen der Kirchenväter bis Augustinus zu Sexualität und Lebensführung –, sondern zu Foucaults Werk im Allgemeinen und den großen Fragen nach Macht, Freiheit und Kritik, die dessen Rezeption bestimmen. Und tatsächlich bietet der Band überraschend neue Einsichten, (...) in deren Lichte sich die herrschende Meinung zu Foucaults Freiheits- und Kritikbegriff als falsch herausstellt. Heute ist die These verbreitet, dass Foucaults Arbeiten zur antiken Ethik und parrhesia als Beitrag zu einem normativen Freiheitsbegriff gewertet werden können. Dagegen zeigt Die Geständnisse des Fleisches, dass die für Foucault und unsere Gegenwart relevante Freiheit, die Fähigkeit zur reflexiven Selbst- und Machtkritik, ihren Ursprung in den Subjektivierungen des frühen Christentums hat, das Subjektivität zum ersten Mal an kritische Machtreflexion koppelt. We live in very Foucauldian times, as the many think-pieces published on biopolitics and COVID-19 show. Yet what is remarkable—biopolitically—about the current situation has gone largely unnoticed: We are witnessing a new form of biopolitics today that could be termed populist biopolitics. Awareness of this populist biopolitics helps illuminate what is needed today: democratic biopolitics.

Wie können Freiheit und Widerstand innerhalb von Foucaults Theorie der Macht und Subjektivierung konzipiert werden? Diese zentrale Frage der Interpretation von Foucaults vielschichtigem Werk wurde breit diskutiert und dennoch nicht befriedigend beantwortet. Dass bis heute kaum Klarheit über den Status von Freiheit in Foucaults Werk erreicht werden konnte, liegt auch daran, dass die gängigen Interpretationen die verschiedenen Freiheitsbegriffe, die in Foucaults Werk zu finden sind, vermischen. Der Artikel bringt deshalb Ordnung in diese unübersichtliche Lage, indem er die verschiedenen Freiheitsbegriffe und (...) Freiheitsprobleme in Foucaults Werk differenziert. Dies ermöglicht ein besseres Verständnis von Foucaults Freiheitsdenken und Machttheorie und führt zu einem neuen Freiheitsbegriff: Freiheit als die Fähigkeit zur kritischen Reflexion der eigenen Subjektivierung. Weil diese "Freiheit als Kritik" nur durch politische Institutionen ermöglicht werden kann, produziert dieser Freiheitsbegriff neue Anschlüsse von Foucaults Denken an die normative politische Theorie und postfundamentalistische Demokratietheorie. How can freedom and resistance be conceived within Foucault's theory of power and subjectivation? This central question of the interpretation of Foucault's multi-layered work has been widely discussed and yet not satisfactorily answered. The fact that until today there has been little clarity about the status of freedom in Foucault's work is also due to the fact that the current interpretations confuse the various concepts of freedom which can be found in Foucault's work. The article therefore brings order to this confusing situation by differentiating the various concepts and problems of freedom in Foucault's work. This enables a better understanding of Foucault's thinking of freedom and his theory of power and leads to a new concept of freedom: freedom as the capability to critically reflect on one's own subjectivation. Because this "freedom as critique" can only be made possible by political institutions, this concept of freedom produces new connections from Foucault's thinking to normative political theory and post-fundamentalist democratic theory. Is there some general reason to expect organisms that have beliefs to have false beliefs? And after you observe that an organism occasionally occupies a given neural state that you think encodes a perceptual belief, how do you evaluate hypotheses about the semantic content that that state has, where some of those hypotheses attribute beliefs that are sometimes false while others attribute beliefs that are always true? To address the first of these questions, we discuss evolution by natural selection and (...) show how organisms that are risk-prone in the beliefs they form can be fitter than organisms that are risk-free. To address the second question, we discuss a problem that is widely recognized in statistics – the problem of over-fitting – and one influential device for addressing that problem, the Akaike Information Criterion (AIC). We then use AIC to solve epistemological versions of the disjunction and distality problems, which are two key problems concerning what it is for a belief state to have one semantic content rather than another.
